Agreement to Terms

By accessing or using Hawaii Dive Center's services, website, or mobile application, you agree to be bound by these Terms and Conditions. Hawaii Dive Center is a 501(c)(3) non-profit organization based in Honolulu, Hawaii.

Participation Requirements

All participants must be in good physical health. Certain medical conditions may disqualify individuals from participation. A signed medical questionnaire and liability waiver are required before any in-water activity. Participants under 18 must have a parent or guardian sign all required forms.

Assumption of Risk

Scuba diving and ocean activities involve inherent risks including, but not limited to, decompression sickness, marine life encounters, equipment failure, and adverse weather conditions. By participating, you acknowledge and voluntarily assume all such risks.

Reservations & Cancellations

Reservations are confirmed upon receipt of payment. Cancellations made more than 48 hours before the scheduled activity receive a full credit. Cancellations within 48 hours are non-refundable. Hawaii Dive Center reserves the right to cancel activities due to unsafe weather or ocean conditions, in which case a full credit or refund will be issued.

Equipment & Conduct

All equipment must be used as instructed by Hawaii Dive Center staff. Participants are responsible for any damage caused by negligence or misuse. Hawaii Dive Center reserves the right to remove any participant from an activity for unsafe, disruptive, or disrespectful behavior without refund.

Marine Conservation

As a conservation-focused organization, we require all participants to respect marine life and coral ecosystems. Do not touch, collect, or disturb any marine organisms. Any damage to coral or protected species may result in immediate removal and potential legal liability.

Photography & Media

Hawaii Dive Center may photograph or video participants during activities for use in marketing and educational materials. By participating, you grant Hawaii Dive Center a non-exclusive license to use your likeness. If you do not wish to be photographed, please notify staff before the activity.

Limitation of Liability

To the fullest extent permitted by law, Hawaii Dive Center, its officers, staff, and volunteers shall not be liable for any injury, loss, or damage arising from participation in its activities, except in cases of gross negligence or willful misconduct.

Governing Law

These Terms and Conditions are governed by the laws of the State of Hawaii. Any disputes shall be resolved in the courts of Honolulu, Hawaii.

Mobile Terms of Service (SMS Messaging)

By opting in to receive SMS text messages from Hawaii Dive Center, you agree to the following Mobile Terms of Service. 11.1 PROGRAM DESCRIPTION: Hawaii Dive Center offers text messaging services to provide booking confirmations, reservation reminders, schedule changes, safety alerts, conservation program updates, and promotional offers. 11.2 USER OPT-IN: You opt in to the SMS service by providing your mobile number during registration or booking and checking the SMS consent checkbox (which is unchecked by default), or by texting START to our designated number. Consent is not a condition of any purchase. 11.3 MESSAGE FREQUENCY AND RATES: Message frequency varies depending on your bookings and interactions. You may receive up to 4-6 messages per month. Standard message and data rates may apply. Check with your mobile carrier for pricing plans. 11.4 OPT-OUT INSTRUCTIONS: You may cancel the SMS service at any time. To opt out, reply STOP to any text message you receive from us. After sending STOP, you will receive one single confirmation message confirming that you have been unsubscribed. No further messages will be sent unless you opt in again. 11.5 HELP AND SUPPORT: For help or support regarding our SMS service, reply HELP to any text message, email us at info@hawaiidivecenter.com, or call us at 808-855-DIVE (3483). 11.6 CARRIER LIABILITY DISCLAIMER: Carriers are not liable for delayed or undelivered messages. Hawaii Dive Center and mobile carriers are not responsible for delays or failure in delivery of any text messages, as delivery is subject to effective transmission from your network operator. 11.7 PRIVACY: Your privacy is important to us.
