HAWAII DIVE CENTER — LIABILITY RELEASE & ASSUMPTION OF RISK WAIVER

This Liability Release and Assumption of Risk Agreement ("Agreement") is entered into by the undersigned participant ("Participant") and Hawaii Dive Center ("HDC"), located in Honolulu, Hawaii.

1. ASSUMPTION OF RISK Participant acknowledges that scuba diving and snorkeling activities involve inherent risks, including but not limited to: drowning, decompression sickness (DCS), arterial air embolism, barotrauma, marine life injuries, equipment failure, adverse weather and sea conditions, physical exertion, and other unforeseen hazards. Participant voluntarily assumes all such risks.

2. MEDICAL FITNESS Participant certifies that they are in good physical health and have no medical conditions that would prevent safe participation in diving activities. Participant has consulted or agrees to consult a physician if any doubt exists about their fitness to dive.

3. RELEASE OF LIABILITY In consideration of being permitted to participate in any diving activities organized by HDC, Participant, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, discharges, and covenants not to sue HDC, its owners, operators, employees, agents, and assigns from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by Participant while participating in these activities, regardless of negligence.

4. INDEMNIFICATION Participant agrees to indemnify and hold harmless HDC and its representatives from any loss, liability, damage, or cost incurred due to Participant's participation in diving activities.

5. EQUIPMENT USE Participant agrees to use all provided equipment responsibly and in accordance with HDC staff instructions. Participant accepts financial responsibility for any damage caused by misuse or negligence.

6. PHOTOGRAPHY & MEDIA Participant grants HDC the right to use photographs, videos, or recordings taken during activities for promotional purposes, unless otherwise stated in writing.

7. GOVERNING LAW This Agreement shall be governed by the laws of the State of Hawaii. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

8. ACKNOWLEDGMENT By signing below, Participant confirms they have read, understood, and voluntarily agree to all terms of this Agreement. Participant acknowledges no warranties have been made regarding the safety of the activities.
